11  The Committee on Community Affairs (Clary) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  Paragraph (c) of subsection (2) of section
19  163.3180, Florida Statutes, is amended to read:
20         163.3180  Concurrency.--
21         (2)
22         (c)  Consistent with the public welfare, and except as
23  otherwise provided in this section, transportation facilities
24  needed to serve new development shall be in place or under
25  actual construction within 3 years after the local government
26  approves a building permit or its functional equivalent that
27  results in traffic generation. Nothing in this section
28  prohibits a local government that has adopted a stricter
29  concurrency management system prior to the enactment of
30  chapter 2005-290, Laws of Florida, which provides for a
31  shorter time period than 3 years from using the stricter
