11  The Committee on Governmental Oversight and Productivity
12  (Constantine) recommended the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 1, line 21, through
16            page 2, line 2, delete those lines
17  
18  and insert:  
19         (a)  Division of Emergency Management. The division is
20  a separate budget entity and is not subject to control,
21  supervision, or direction by the Department of Community
22  Affairs in any manner, including, but not limited to,
23  personnel, purchasing, transactions involving personal
24  property, and budgetary matters. The division director shall
25  be appointed by the Governor, shall serve at the pleasure of
26  the Governor, and shall be the agency head of the division for
27  all purposes. The division shall enter into a service
28  agreement with the department for professional, technological,
29  and administrative support services. The division shall
30  collaborate and coordinate with the department on nonemergency
31  response matters, including, but not limited to, disaster

 1  recovery programs, grant programs, mitigation programs, and
 2  emergency matters related to comprehensive plans.

 9         On page 1, lines 5-10, delete those lines
10  
11  and insert:
12         Management be designated as agency head of the
13         division; providing that the director be
14         appointed by the Governor; providing that the
15         division is a separate budget entity, not
16         subject to control by the department; providing
17         for an agreement between the division and
18         department for certain services; prescribing
19         duties of the division;
