13         Senate Amendment 
14         On page 153, lines 11-25, delete those lines
15  
16  and insert:  
17         BE IT FURTHER RESOLVED that the following statement be
18  placed on the ballot:
19                     CONSTITUTIONAL REVISION
20                        MULTIPLE ARTICLES
21         OBSOLETE, ERRONEOUS, AND UNCONSTITUTIONAL PROVISIONS;
22  PRESERVATION OF CERTAIN CONSTITUTIONAL PROVISIONS AS
23  STATUTES.--Proposing a revision of the State Constitution to
24  correct spelling errors, punctuation errors, grammatical
25  errors, repeal obsolete provisions, repeal provisions that
26  violate the United States Constitution, and make technical
27  changes; to correct an erroneous filing date in Article XI,
28  section 6(e), which relates to the Taxation and Budget Reform
29  Commission; and to repeal the following provisions from the
30  State Constitution, codify them in the Florida Statutes, and
31  prohibit the Legislature from modifying, repealing, or acting

 1  inconsistently with those statutes until January 2, 2015,
 2  except upon a three-fourths vote of both houses of the
 3  Legislature:
 4                      ARTICLE I, SECTION 26
 5         Claimant's right to fair compensation.--This provision
 6  provides that an injured claimant who enters into a
 7  contingency fee agreement with an attorney in a claim for
 8  medical liability is entitled to no less than 70% of the first
 9  $250,000.00 in all damages received by the claimant, and 90%
10  of damages in excess of $250,000.00, exclusive of reasonable
11  and customary costs and regardless of the number of
12  defendants.
13                      ARTICLE X, SECTION 21
14         Limiting cruel and inhumane confinement of pigs during
15  pregnancy.--This provision makes it unlawful to confine a pig
16  during pregnancy in a cage, crate or other enclosure, or
17  tether a pregnant pig, on a farm so that the pig is prevented
18  from turning around freely, except for veterinary purposes and
19  during the prebirthing period.
20                      ARTICLE X, SECTION 25
21         Patients' right to know about adverse medical
22  incidents.--This provision gives patients the right to review,
23  upon request, records of health care facilities' or providers'
24  adverse medical incidents, including those which could cause
25  injury or death.
26                      ARTICLE X, SECTION 26
27         Prohibition of medical license after repeated medical
28  malpractice.--This provision prohibits medical doctors who
29  have been found to have committed three or more incidents of
30  medical malpractice from being licensed to practice medicine
31  in Florida.
