A bill to be entitled
2An act relating to the Florida KidCare program; amending
3s. 409.814, F.S.; authorizing eligibility for coverage in
4the Florida KidCare program for additional categories of
5children; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Subsections (2) and (5) of section 409.814,
10Florida Statutes, are amended to read:
11     409.814  Eligibility.--A child who has not reached 19 years
12of age whose family income is equal to or below 200 percent of
13the federal poverty level is eligible for the Florida KidCare
14program as provided in this section. For enrollment in the
15Children's Medical Services Network, a complete application
16includes the medical or behavioral health screening. If,
17subsequently, an individual is determined to be ineligible for
18coverage, he or she must immediately be disenrolled from the
19respective Florida KidCare program component.
20     (2)  A child who is not eligible for Medicaid, but who is
21eligible for the Florida KidCare program, may obtain health
22benefits coverage under any of the other components listed in s.
23409.813 if such coverage is approved and available in the county
24in which the child resides. However, a child who is eligible for
25Medikids, including those eligible under subsection (5), may
26participate in the Florida Healthy Kids program only if the
27child has a sibling participating in the Florida Healthy Kids
28program and the child's county of residence permits such
29enrollment.
30     (5)  A child whose family income is above 200 percent of
31the federal poverty level or a child who is excluded under the
32provisions of subsection (4) may apply for coverage and shall be
33allowed to participate in the Florida KidCare program, excluding
34the Medicaid program, but is subject to the following
35provisions:
36     (a)  The family is not eligible for premium assistance
37payments and must pay the full cost of the premium, including
38any administrative costs.
39     (b)  The agency is authorized to place limits on enrollment
40in Medikids by these children in order to avoid adverse
41selection. The number of children participating in Medikids
42whose family income exceeds 200 percent of the federal poverty
43level must not exceed 10 percent of total enrollees in the
44Medikids program.
45     (c)  The board of directors of the Florida Healthy Kids
46Corporation is authorized to place limits on enrollment of these
47children in order to avoid adverse selection. In addition, the
48board is authorized to offer a reduced benefit package to these
49children in order to limit program costs for such families. The
50number of children participating in the Florida Healthy Kids
51program whose family income exceeds 200 percent of the federal
52poverty level must not exceed 10 percent of total enrollees in
53the Florida Healthy Kids program.
54     (d)  Children described in this subsection are not counted
55in the annual enrollment ceiling for the Florida KidCare
56program.
57     Section 2.  This act shall take effect July 1, 2006.
