| 4 | On page 28, between lines 29 and 30, insert: |
| 5 | (5) The commission shall adopt a rule establishing |
| 6 | adequate due process procedures to be accorded to any party, as |
| 7 | defined in s. 120.52, whose substantial interests are affected |
| 8 | by any action of the commission in the performance of its |
| 9 | constitutional duties and responsibilities. The adequate due |
| 10 | process rule shall be published in the Florida Administrative |
| 11 | Code. |
| 12 | (6) All existing and proposed rules of the commission |
| 13 | shall be subject to the provisions of s. 120.56. |
| 14 | Section 9. The Fish and Wildlife Conservation Commission's |
| 15 | enforcement of all penalty provisions under this act shall be |
| 16 | contingent upon the final adoption of the adequate due process |
| 17 | rule as required under s. 370.025(5), Florida Statutes. |
| 18 | Section 10. All appropriations to the Fish and Wildlife |
| 19 | Conservation Commission for the 2006-2007 fiscal year shall be |
| 20 | contingent upon the final adoption of the adequate due process |
