  1                      A bill to be entitled

  2         An act relating to hurricane evacuation

  3         shelters; amending s. 252.385, F.S.; requiring

  4         public and private commercial buildings that

  5         are built after a certain date and meet certain

  6         standards to be constructed according to the

  7         design criteria published by the American Red

  8         Cross in order to serve a secondary purpose as

  9         a hurricane evacuation shelter; prohibiting a

10         building permit from being issued for a

11         construction project until the design is

12         certified to be in compliance with certain

13         standards; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Paragraph (d) is added to subsection (4) of

18  section 252.385, Florida Statutes, to read:

19         252.385  Public shelter space.--

20         (4)

21         (d)  Public and private commercial buildings built

22  after July 1, 2006, having at least 2,000 square feet of net

23  floor area in a single room, and capable of complying with the

24  current standards to avoid storm-surge inundation as published

25  by the American Red Cross shall be constructed according to

26  the design criteria published by the American Red Cross in

27  order to serve a secondary purpose as a hurricane evacuation

28  shelter. A building permit may not be issued for such a

29  construction project until the design is certified to be in

30  compliance with the standards for construction of a hurricane

31  evacuation shelter.
