| 1 | The Insurance Committee recommends the following: |

| 4 | Remove the entire bill and insert: | 
| 5 | A bill to be entitled | 
| 6 | An act relating to travel-limited life insurance coverage; | 
| 7 | providing a purpose; specifying prohibited activities by | 
| 8 | insurers for life insurance coverage relating to lawful | 
| 9 | travel experiences; authorizing the Financial Services | 
| 10 | Commission to adopt rules and provide certain limited | 
| 11 | exceptions based on emergency conditions; providing an | 
| 12 | effective date. | 
| 13 |

| 14 | Be It Enacted by the Legislature of the State of Florida: | 
| 15 | 
 | 
| 16 | Section 1.  (1)  The purpose of this act is to prohibit a | 
| 17 | life insurance company from refusing to insure or refusing to | 
| 18 | continue to insure an individual, limiting the amount, extent, | 
| 19 | or kind of coverage available to an individual, or charging an | 
| 20 | individual a different rate for the same coverage solely for | 
| 21 | reasons associated with an applicant's or insured's past or | 
| 22 | future lawful travel experiences. | 
| 23 | (2)  An insurer may not refuse to insure or refuse to | 
| 24 | continue to insure an individual, limit the amount, extent, or | 
| 25 | kind of life insurance coverage available to an individual, or | 
| 26 | charge an individual a different rate for the same coverage | 
| 27 | solely for reasons associated with an applicant's or insured's | 
| 28 | past or future lawful travel experiences. | 
| 29 | (3)  The Financial Services Commission may adopt rules | 
| 30 | necessary to implement this section and may provide for limited | 
| 31 | exceptions that are based upon national or international | 
| 32 | emergency conditions that affect the public health, safety, and | 
| 33 | welfare and that are consistent with public policy. | 
| 34 | Section 2.  This act shall take effect July 1, 2006. |
