2 An act relating to the Agency for Persons with
3 Disabilities; amending s. 20.197, F.S.;
4 providing for the agency head to be subject to
5 confirmation by the Senate; providing an
6 effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (1) of section 20.197, Florida
11 Statutes, is amended to read:
12 20.197 Agency for Persons with Disabilities.--There is
13 created the Agency for Persons with Disabilities, housed
14 within the Department of Children and Family Services for
15 administrative purposes only. The agency shall be a separate
16 budget entity not subject to control, supervision, or
17 direction by the Department of Children and Family Services in
18 any manner, including, but not limited to, personnel,
19 purchasing, transactions involving real or personal property,
20 and budgetary matters.
21 (1) The director of the agency shall be the agency
22 head for all purposes and shall be appointed by the Governor,
23 subject to confirmation by the Senate, and shall serve at the
24 pleasure of the Governor. The director shall administer the
25 affairs of the agency and establish administrative units as
26 needed and may, within available resources, employ assistants,
27 professional staff, and other employees as necessary to
28 discharge the powers and duties of the agency.
29 Section 2. This act shall take effect upon becoming a
30 law.
