  1                      A bill to be entitled

  2         An act relating to public records; amending s.

  3         744.7082, F.S.; creating an exemption from

  4         public-records requirements for identifying

  5         information of persons making a donation of

  6         funds or property to the direct-support

  7         organization of the Statewide Public

  8         Guardianship Office; providing for review and

  9         repeal under the Open Government Sunset Review

10         Act; providing a statement of public necessity;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Present subsections (6) and (7) of section

16  744.7082, Florida Statutes, are redesignated as subsections

17  (7) and (8), respectively, and a new subsection (6) is added

18  to that section, to read:

19         744.7082  Direct-support organization; definition; use

20  of property; board of directors; audit; dissolution.--

21         (6)  PUBLIC RECORDS.--The identity of a donor or

22  prospective donor of funds or property to the direct-support

23  organization who desires to remain anonymous, and all

24  information identifying the donor or prospective donor, is

25  confidential and exempt from the provisions of s. 119.07(1)

26  and s. 24(a), Art. I of the State Constitution, and that

27  anonymity must be maintained in any publication concerning the

28  direct-support organization. This subsection is subject to the

29  Open Government Sunset Review Act in accordance with s.

30  119.15, Florida Statutes, and shall stand repealed on October

 1  2, 2011, unless reviewed and saved from repeal through

 2  reenactment by the Legislature.

 3         Section 2.  The Legislature finds that it is a public

 4  necessity that the name and other identifying information of a

 5  donor or prospective donor to the direct-support organization

 6  of the Statewide Public Guardianship Office be held

 7  confidential and exempt from public disclosure because the

 8  disclosure of this information would adversely impact the

 9  efforts of the direct-support organization to collect funding

10  or gifts of property to support the statewide office. The sole

11  purpose of the direct-support organization is to raise funds

12  for the statewide office, and donor contributions are a key

13  element in the ability of the the organization to achieve its

14  goals. Some individuals who desire to donate to the

15  direct-support organization wish to remain anonymous. The

16  direct-support organization would be adversely affected if

17  identifying information of a donor is released to the public.

18  Therefore, the Legislature finds that any benefit derived from

19  public disclosure of identifying information of a donor is

20  outweighed by the necessity to keep the information

21  confidential.

22         Section 3.  This act shall take effect July 1, 2006.
