1 A bill to be entitled
2 An act relating to drawings by chance; amending
3 s. 849.0935, F.S.; including chambers of
4 commerce that qualify under 26 U.S.C. s.
5 501(c)(6) in the organizations that may conduct
6 drawings by chance; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (b) of subsection (1) and
12 subsection (2) of section 849.0935, Florida Statutes, are
13 amended to read:
14 849.0935 Charitable, nonprofit organizations; drawings
15 by chance; required disclosures; unlawful acts and practices;
16 penalties.--
17 (1) As used in this section, the term:
18 (b) "Organization" means an organization that which is
19 exempt from federal income taxation pursuant to 26 U.S.C. s.
20 501(c)(3), (4), (7), (8), (10), or (19), or a chamber of
21 commerce pursuant to 26 U.S.C. s. 501(c)(6), and which has a
22 current determination letter from the Internal Revenue
23 Service, and its bona fide members or officers.
24 (2) The provisions of s. 849.09 shall not be construed
25 to prohibit an organization qualified under 26 U.S.C. s.
26 501(c)(3), (4), (7), (8), (10), or (19), or a chamber of
27 commerce qualified under 26 U.S.C. s. 501(c)(6), from
28 conducting drawings by chance pursuant to the authority
29 granted by this section, provided the organization has
30 complied with all applicable provisions of chapter 496.
31 Section 2. This act shall take effect July 1, 2006.
