4     Between lines 24 and 25, insert:
5     Section 1.  Section 395.1051, Florida Statutes, is amended
6to read:
7     395.1051  Duty to notify patients.--
8     (1)  An appropriately trained person designated by each
9licensed facility shall inform each patient, or an individual
10identified pursuant to s. 765.401(1), in person about adverse
11incidents that result in serious harm to the patient.
12Notification of outcomes of care that result in harm to the
13patient under this section shall not constitute an
14acknowledgment or admission of liability, nor can it be
15introduced as evidence.
16     (2)  Prior to provision of any nonemergency medical
17services, each licensed facility not operated by the state shall
18provide to a patient a copy of the information reported on
19www.floridacomparecare.gov as the information relates to the
20average charge for the procedure, average length of stay, and
21the quality outcome measures reported by the agency specific to
22the patient's condition. The average charge information for a
23specific diagnosis-related group or the average charge for a
24procedure shall not preclude the actual charges from exceeding
25the reported amount. Failure to provide the information within
26the provisions established pursuant to this section shall result
27in a fine of $500 for each instance of the facility's failure to
28provide the required information.
