| 8 | district school boards to purchase and provide a classroom |
| 9 | set of textbooks for use in certain grade 6 through grade |
| 10 | 8 classrooms; providing an effective date. |

| 12 | WHEREAS, because of the elimination of lockers in many |
| 13 | middle schools, students must carry their issued textbooks |
| 14 | throughout the school day, and |
| 15 | WHEREAS, carrying such books has the potential to lead to |
| 16 | minor to severe back problems, NOW, THEREFORE, |
| 17 |
|
| 18 | Be It Enacted by the Legislature of the State of Florida: |
| 19 |
|
| 20 | Section 1. Paragraph (b) of subsection (1) of section |
| 21 | 1006.28, Florida Statutes, is amended to read: |
| 22 | 1006.28 Duties of district school board, district school |
| 23 | superintendent; and school principal regarding K-12 |
| 24 | instructional materials.-- |
| 25 | (1) DISTRICT SCHOOL BOARD.--The district school board has |
| 26 | the duty to provide adequate instructional materials for all |
| 27 | students in accordance with the requirements of this part. The |
| 28 | term "adequate instructional materials" means a sufficient |
| 29 | number of textbooks or sets of materials serving as the basis |
| 30 | for instruction for each student in the core courses of |
| 31 | mathematics, language arts, social studies, science, reading, |
| 32 | and literature, except for instruction for which the school |
| 33 | advisory council approves the use of a program that does not |
| 34 | include a textbook as a major tool of instruction. The district |
| 35 | school board has the following specific duties: |
| 36 | (b) Textbooks.-- |
| 37 | 1. Provide for proper requisitioning, distribution, |
| 38 | accounting, storage, care, and use of all instructional |
| 39 | materials furnished by the state and furnish such other |
| 40 | instructional materials as may be needed. The district school |
| 41 | board shall assure that instructional materials used in the |
| 42 | district are consistent with the district goals and objectives |
| 43 | and the curriculum frameworks adopted by rule of the State Board |
| 44 | of Education, as well as with the state and district performance |
| 45 | standards provided for in s. 1001.03(1). |
| 46 | 2. During the first 2 years of the adoption cycle, |
| 47 | beginning with the 2006-2007 school year, purchase sufficient |
| 48 | textbooks to provide a classroom set of textbooks for use in |
| 49 | each core curriculum classroom in grades 6 through 8. The |
| 50 | purchase of textbooks pursuant to this subparagraph shall not |
| 51 | affect the issuance of textbooks to each student. |
| 52 | Section 2. This act shall take effect July 1, 2006. |
