A bill to be entitled
2An act relating to a motor vehicle safety pilot program;
3requiring certain limited access facilities that are
4adjacent to a canal or other water body to have a system
5of guardrails, retention cables, or other barriers between
6the highway and the canal or water body; providing for the
7Department of Transportation to establish certain
8standards governing the installation and maintenance of
9the barriers; requiring that barriers be installed for
10existing highways by a specified date; providing for
11future review and repeal; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Barrier required between a highway and a canal
16or a water body.--
17     (1)  Each limited access facility in Miami-Dade County that
18is adjacent to a canal or other water body must have a system of
19guardrails, retention cables, or other barriers between the
20highway and the canal or water body which are installed and
21maintained in conformance with standards established by the
22Florida Department of Transportation. The standards should
23consider loss of life by safely preventing out-of-control motor
24vehicles from entering the canal or water body, as well as the
25width or depth of the canal or water body or its proximity to
26the traveled way of the highway.
27     (2)  For a limited access facility in existence on July 1,
282006, the barriers required under this section must be installed
29on or before December 31, 2009.
30     (3)  This pilot program shall stand repealed December 31,
312011, unless reviewed and saved from repeal through enactment by
32the Legislature.
33     Section 2.  This act shall take effect July 1, 2006.
