| 5 | Section 4. Notwithstanding any other provision in this |
| 6 | act, in order to qualify for funds distributed, the Office of |
| 7 | Tourism and Economic Development must determine that the |
| 8 | applicant has a history of financial investment in its |
| 9 | community. In order to remain annually eligible, the Office of |
| 10 | Tourism and Economic Development must also determine on an |
| 11 | annual basis that financial investment continues. As used in |
| 12 | this paragraph, the term "financial investment" shall be defined |
| 13 | as having made donations equal to a minimum of 80 percent of |
| 14 | each annual distribution: |
| 15 | (1) To a nonprofit center under s. 501(c)(3) of the |
| 16 | Internal Revenue Code assisting developmentally disabled |
| 17 | individuals in the local community; or |
| 18 | (2) To a nonprofit organization under s. 501(c)(3) of the |
| 19 | Internal Revenue Code advocating additional funding and support |
| 20 | for the developmentally disabled. |
