A bill to be entitled
2An act relating to the Hillsborough County Aviation
3Authority; amending chapter 2003-370, Laws of Florida,
4relating to the award of contracts; increasing the minimum
5amount at which certain contracts are subject to
6competitive bidding or require sureties; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraphs (a), (b), and (c) of subsection (1)
12of section 11 of section 3 of chapter 2003-370, Laws of Florida,
13are amended to read:
14     Section 11.  Award of contracts.--
15     (1)(a)  Except when done by employees of the Authority or
16by labor supplied under agreement with the federal, state, or
17local government or when required by or using the Consultants'
18Competitive Negotiation Act, all construction, improvements,
19repairs, or work of any nature done by the Authority, where the
20entire cost or value exceeds $30,000 $15,000, shall be done only
21under contract or contracts entered into by the Authority with
22the lowest responsive bid from a qualified responsible bidder
23upon proper terms, after advertisement has been given asking for
24competitive bids, provided that the Authority may reject any and
25all bids.
26     (b)  Any contract subject to section 255.05, Florida
27Statutes, as may be amended from time to time, in excess of
28$50,000 $15,000 shall not be entered into for construction,
29improvement, or repair of Authority facilities unless the
30contractor has sufficient surety or sureties, approved by the
31Authority, and in an amount fixed by the Authority, for the
32faithful performance of the contract. Any such contract shall
33include provisions that the person entering into the contract
34with the Authority will pay for all materials furnished and
35services rendered for the performance of the contract and may
36maintain an action to recover for the same against the obligor
37in the undertaking, as though such person was named therein,
38provided the action is brought within 1 year after the time the
39cause of action accrued. Nothing in this section shall be
40construed to limit the power of the Authority to construct,
41repair, or improve Authority facilities or any addition,
42betterment, or extension thereto, directly by the officers,
43agents, and employees of the Authority, or otherwise than by
44contract.
45     (c)  All supplies and materials costing in excess of
46$30,000 $15,000 shall be purchased only after advertisement. The
47Authority shall accept the lowest responsive bid from a
48responsible bidder, kind, quality, and material being equal, but
49the Authority has the right to reject any or all bids or select
50a single item from any bid.
51     Section 2.  This act shall take effect upon becoming a law.
