4     On page 1, between line(s) 21 and 22, insert:
5     Section 2.  Paragraph (a) of subsection (2), paragraph (a)
6of subsection (4), paragraph (c) of subsection (7), and
7paragraph (c) of subsection (12) of section 849.086, Florida
8Statutes, are amended to read:
9     849.086  Cardrooms authorized.--
10     (2)  DEFINITIONS.--As used in this section:
11     (a)1.  "Authorized game" means a game or series of games of
12poker which are played in a nonbanking manner.
13     2.  "Authorized game facilitated by certified electronic
14gaming equipment" means an authorized game as defined in
15subparagraph 1. which is played on an electronic poker table
16that shuffles, deals, pays pots, and otherwise conducts the game
17electronically so that players can play the game without a human
18dealer. The electronic gaming equipment must be certified by a
19department-approved, independent testing laboratory as providing
20a mathematically random shuffle and deal process with an equal
21probability of occurrence for each card.
22     (4)  AUTHORITY OF DIVISION.--The Division of Pari-mutuel
23Wagering of the Department of Business and Professional
24Regulation shall administer this section and regulate the
25operation of cardrooms under this section and the rules adopted
26pursuant thereto, and is hereby authorized to:
27     (a)  Adopt rules, including, but not limited to: the
28issuance of cardroom and employee licenses for cardroom
29operations; the operation of a cardroom; procedures for and
30operation of authorized games facilitated by certified
31electronic gaming equipment; recordkeeping and reporting
32requirements; and the collection of all fees and taxes imposed
33by this section.
34     (7)  CONDITIONS FOR OPERATING A CARDROOM.--
35     (c)  Except for authorized games facilitated by certified
36electronic gaming equipment, a cardroom operator must at all
37times employ and provide a nonplaying dealer for each table on
38which authorized card games which traditionally utilize a dealer
39are conducted at the cardroom. Such dealers may not have any
40participatory interest in any game other than the dealing of
41cards and may not have an interest in the outcome of the game.
42The providing of such dealers by a licensee shall not be
43construed as constituting the conducting of a banking game by
44the cardroom operator.
45     (12)  PROHIBITED ACTIVITIES.--
46     (c)  No electronic or mechanical devices, except mechanical
47card shufflers or authorized games facilitated by certified
48electronic gaming equipment, may be used to conduct any
49authorized game in a cardroom.
