10     (1)  That portion of Okeechobee Road, U.S. Highway 27/State
11Road 25, between W. 12th Street and W. 19th Street in Miami-Dade
12County is designated as "Raul L. Martinez/Jose Abreu Pass."
13     (2)  The Department of Transportation is directed to erect
14suitable markers designating Raul L. Martinez/Jose Abreu Pass as
15described in subsection (1).
16     Section 22.  Mayor Raul L. Martinez Street designated;
17Department of Transportation to erect suitable markers.--
18     (1)  That portion of 49th Street within the boundaries of
19the City of Hialeah in Miami-Dade County is designated as "Mayor
20Raul L. Martinez Street."
21     (2)  The Department of Transportation is directed to erect
22suitable markers designating Mayor Raul L. Martinez Street as
23described in subsection (1).
24     Section 23.  Dr. Vicente Grau-Imperatori Street designated;
25Department of Transportation to erect suitable markers.--
26     (1)  That portion of S.W. 8th Street between S.W. 67th
27Avenue and S.W. 72nd Avenue in Miami-Dade County is designated
28as "Dr. Vicente Grau-Imperatori Street."
29     (2)  The Department of Transportation is directed to erect
30suitable markers designating Dr. Vicente Grau-Imperatori Street
31as described in subsection (1).
32     Section 24.  William Nathey Bridge designated; Department
33of Transportation to erect suitable markers.--
34     (1)  That bridge, number 570125, on State Road 85, which
35crosses Boggy Bayou in Okaloosa County, is designated as
36"William Nathey Bridge."
37     (2)  The Department of Transportation is directed to erect
38suitable markers designating William Nathey Bridge as described
39in subsection (1).
40     Section 25.  Sergeant Nicholas Sottile honored; Department
41of Transportation to erect suitable markers.--
42     (1)  That portion of State Road 70 near U.S. Highway 27 in
43Highlands County is dedicated to the memory of Highway Patrol
44Sergeant Nicholas Sottile.
45     (2)  The Department of Transportation is directed to erect
46suitable signage, pursuant to subsection (1), bearing the
47inscription, "In Memory of Sergeant Nicholas Sottile of the
48Florida Highway Patrol, who was killed in the line of duty
49during a traffic stop."
50     Section 26.  (1)  That portion of Brickell Avenue situated
51within the corporate limits of the City of Miami and lying
52between S.E. 25th Street and the south shoreline of the Miami
53River is designated as a state historic road. No state funds
54shall be expended by any public body or agency to alter its
55location whether by extension of its boundaries or the extension
56of the name Brickell Avenue.
57(2)  Nothing in this section shall be construed to prevent
58the ordinary maintenance and repair of that portion of Brickell
59Avenue situated within the corporate limits of the City of Miami
60and lying between S.E. 25th Street and the south shoreline of
61the Miami River, provided the location of the historic road is
62preserved; to prevent the removal or replacement of any
63landscaping, including any hammock, banyan, or mahogany trees
64located on either side of the paved surface of the road or in
65the central media of the road; to prevent any work that is
66necessary for the public health or safety as determined by the
67agency having jurisdiction over that portion of Brickell Avenue
68described in subsection (1); to prevent the removal of invasive
69plant species on the roadway or right-of-way; to prevent such
70action deemed necessary to clear or maintain the road subsequent
71to a natural disaster such as a hurricane; to limit widening or
72physical changes to Brickell Avenue to improve vehicular or
73pedestrian movement; or to limit the commercial development
74adjacent to the roadway. The term "ordinary maintenance" means
75those activities necessary to preserve the existing traffic
76patterns and to accommodate the volume of traffic operating on
77that portion of Brickell Avenue described in subsection (1) as
78of July 1, 2007. However, the preservation of that portion of
79Brickell Avenue described in subsection (1) takes priority over
80considerations of traffic management, and the public safety
81shall not be construed to require alterations in that portion of
82Brickell Avenue described in subsection (1) or its landscaping
83when alternative means of promoting safety, including more
84restrictive regulations, are available.
85     Section 27.  Subsection (26) of section 334.044, Florida
86Statutes, is amended to read:
87     334.044  Department; powers and duties.--The department
88shall have the following general powers and duties:
89     (26)  To provide for the conservation of natural roadside
90growth and scenery and for the implementation and maintenance of
91roadside beautification programs. To accomplish this, for fiscal
92years 1999-2000, 2000-2001, and 2001-2002 no less than 1
93percent, and for subsequent fiscal years no less than 1.5
94percent of the amount contracted for construction projects shall
95be allocated by the department to beautification programs.
96Except where prohibited by federal law or federal regulation and
97to the extent practical, a minimum of 50 percent of these funds
98shall be used to purchase large plant materials with the
99remaining funds for other plant materials. All such plant and
100these materials shall be purchased from Florida-based nurseryman
101stock on a uniform competitive bid basis. The department will
102develop grades and standards for landscaping materials purchased
103through this process. To accomplish these activities, the
104department may contract with nonprofit organizations having the
105primary purpose of developing youth employment opportunities.
