  1                      A bill to be entitled

  2         An act relating to public K-12 education;

  3         amending s. 1001.42, F.S.; providing an

  4         exception to the requirement that a school may

  5         not open earlier than 14 days before Labor Day;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Paragraph (f) of subsection (4) of section

11  1001.42, Florida Statutes, is amended to read:

12         1001.42  Powers and duties of district school

13  board.--The district school board, acting as a board, shall

14  exercise all powers and perform all duties listed below:

15         (4)  ESTABLISHMENT, ORGANIZATION, AND OPERATION OF

16  SCHOOLS.--Adopt and provide for the execution of plans for the

17  establishment, organization, and operation of the schools of

18  the district, including, but not limited to, the following:

19         (f)  Opening and closing of schools; fixing uniform

20  date.--Adopt policies for the opening and closing of schools

21  and fix uniform dates; however, beginning with the 2007-2008

22  school year, the opening date for schools in the district,

23  except schools that operate a year-round program or offer an

24  advanced placement program or a dual enrollment program, may

25  not be earlier than 14 days before Labor Day each year.

26         Section 2.  This act shall take effect July 1, 2007.
