| 3 | s. 947.01, F.S.; deleting an obsolete provision; amending |
| 4 | s. 947.02, F.S.; requiring the commission's membership to |
| 5 | reflect at all times the diversity of the population of |
| 6 | this state; repealing s. 947.022, F.S., which provided for |
| 7 | the expiration of the terms of the members of the |
| 8 | commission as of June 30, 1996, and the staggering of the |
| 9 | initial terms of the members appointed to replace them; |
| 10 | providing an effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Section 947.01, Florida Statutes, is amended to |
| 15 | read: |
| 16 | 947.01 Parole Commission; creation; number of members.--A |
| 17 | Parole Commission is created to consist of three six members who |
| 18 | are residents of the state. Effective July 1, 1996, the |
| 19 | membership of the commission shall be three members. |
| 20 | Section 2. Subsection (1) of section 947.02, Florida |
| 21 | Statutes, is amended to read: |
| 22 | 947.02 Parole Commission; members, appointment.-- |
| 23 | (1) Except as provided in s. 947.021, the members of the |
| 24 | Parole Commission shall be appointed by the Governor and Cabinet |
| 25 | from a list of eligible applicants submitted by a parole |
| 26 | qualifications committee. The appointments of members of the |
| 27 | commission shall be certified to the Senate by the Governor and |
| 28 | Cabinet for confirmation, and the membership of the commission |
| 29 | shall at all times reflect the diversity of the population of |
| 30 | this state include representation from minority persons as |
| 31 | defined in s. 288.703. |
| 32 | Section 3. Section 947.022, Florida Statutes, is repealed. |
| 33 | Section 4. This act shall take effect July 1, 2007. |
