  1                      A bill to be entitled

  2         An act relating to motor vehicles; amending s.

  3         316.2015, F.S.; prohibiting the operator of a

  4         pickup or flatbed truck from allowing a minor

  5         to ride in the open body of the pickup or

  6         flatbed truck while on a public road unless the

  7         minor is restrained in safety restraints or

  8         secure seating; providing certain exceptions;

  9         providing that a county is exempt from the

10         requirement upon a majority vote of the

11         governing body of the county; providing an

12         effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraph (b) of subsection (2) of section

17  316.2015, Florida Statutes, is amended to read:

18         316.2015  Unlawful for person to ride on exterior of

19  vehicle.--

21         (b)  It is unlawful for any operator of a pickup truck

22  or flatbed truck to permit a minor child who has not attained

23  18 years of age to ride upon a public road limited access

24  facilities of the state within the open body of a pickup truck

25  or flatbed truck unless the minor is restrained within the

26  open body in the back of a truck that has been modified to

27  include secure seating and safety restraints or secure seating

28  with safety restraints in order to prevent the passenger from

29  being thrown, falling, or jumping from the truck. This

30  paragraph does not apply in a medical emergency or natural

31  disaster if the child is accompanied within the truck by an

 1  adult. A county is exempt from this paragraph if the governing

 2  body of the county, by majority vote, following a noticed

 3  public hearing, votes to exempt the county from this

 4  paragraph.

 5         Section 2.  This act shall take effect July 1, 2007.

 9    Prohibits a minor from riding in the open body of a
      pickup or flatbed truck on public roads unless the minor
10    is restrained in secure seating.
