| 4 | Remove everything after the enacting clause and insert: |
| 5 | Section 1. Subsection (1) of section 395.003, Florida |
| 6 | Statutes, is amended to read: |
| 7 | 395.003 Licensure; issuance, renewal, denial, |
| 8 | modification, suspension, and revocation.-- |
| 9 | (1)(a) A person may not establish, conduct, or maintain a |
| 10 | hospital, ambulatory surgical center, or mobile surgical |
| 11 | facility in this state without first obtaining a license under |
| 12 | this part. |
| 13 | (b)1. It is unlawful for a person to use or advertise to |
| 14 | the public, in any way or by any medium whatsoever, any facility |
| 15 | as a "hospital," "ambulatory surgical center," or "mobile |
| 16 | surgical facility" unless such facility has first secured a |
| 17 | license under the provisions of this part. |
| 18 | 2. This part does not apply to veterinary hospitals or to |
| 19 | commercial business establishments using the word "hospital," |
| 20 | "ambulatory surgical center," or "mobile surgical facility" as a |
| 21 | part of a trade name if no treatment of human beings is |
| 22 | performed on the premises of such establishments. |
| 23 | 3. Until July 1, 2006, Additional emergency departments |
| 24 | located off the premises of licensed hospitals may not be |
| 25 | authorized by the agency until July 1, 2009, except that a |
| 26 | hospital which has commenced the licensure application process |
| 27 | for an emergency department located off the premises of a |
| 28 | licensed hospital, including the filing of initial documents on |
| 29 | or before April 30, 2007, and has submitted Stage 2 |
| 30 | architectural plans for an emergency department located off the |
| 31 | premises of a licensed hospital as of July 1, 2007, or has |
| 32 | received approval of Stage 2 architectural plans for an |
| 33 | emergency department located off the premises of a licensed |
| 34 | hospital as of July 15, 2007, may be authorized and licensed by |
| 35 | the agency upon compliance with the same requirements as were |
| 36 | imposed on off-premises emergency departments licensed prior to |
| 37 | July 1, 2007. |
| 38 | Section 2. This act shall take effect July 1, 2007. |
