  2         An act relating to annual reports on the

  3         telecommunications industry; amending s.

  4         364.386, F.S.; revising the due date of a

  5         report to the Legislature by the Florida Public

  6         Service Commission on industry competition;

  7         providing for the commission to request data

  8         from providers of local exchange

  9         telecommunications services; requiring such

10         providers to file certain information with the

11         commission; providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 364.386, Florida Statutes, is

16  amended to read:

17         364.386  Reports to the Legislature.--

18         (1)(a)  The commission shall submit to the President of

19  the Senate, the Speaker of the House of Representatives, and

20  the majority and minority leaders of the Senate and the House

21  of Representatives, on August 1, 2008 December 1, 1996, and on

22  an annual basis thereafter, a report on the status of

23  competition in the telecommunications industry and a detailed

24  exposition of the following:

25         1.(a)  The overall impact of local exchange

26  telecommunications competition on the continued availability

27  of universal service.

28         2.(b)  The ability of competitive providers to make

29  functionally equivalent local exchange services available to

30  both residential and business customers at competitive rates,

31  terms, and conditions.

 1         3.(c)  The ability of consumers to obtain functionally

 2  equivalent services at comparable rates, terms, and

 3  conditions.

 4         4.(d)  The overall impact of price regulation on the

 5  maintenance of reasonably affordable and reliable high-quality

 6  telecommunications services.

 7         5.(e)  What additional services, if any, should be

 8  included in the definition of basic local telecommunications

 9  services, taking into account advances in technology and

10  market demand.

11         6.(f)  Any other information and recommendations which

12  may be in the public interest.

13         (b)  The commission shall make an annual request to

14  providers of local exchange telecommunications services on or

15  before March 1, 2008, and on or before March 1 of each year

16  thereafter, for the data it requires to complete the report. A

17  provider of local exchange telecommunications services shall

18  file its response with the commission on or before April 15,

19  2008, and on or before April 15 of each year thereafter.

20         (2)  In lieu of the quantitative part of the

21  information requested in the commission's annual data request,

22  a provider of local exchange telecommunications services may

23  file the following:

24         (a)  A copy of the FCC Form 477 filed with the Federal

25  Communications Commission, which must identify

26  Florida-specific access line data; and

27         (b)  Provisioned Florida access line data identified by

28  telephone exchange location.

29         (3)(2)  The Office of Public Counsel is also directed

30  to submit a report on competition in the telecommunications

31  industry and on how the price regulation provisions of s.

 2  state and any other information and recommendations which may

 3  be in the public interest.

 4         Section 2.  This act shall take effect July 1, 2007.
