4     On page 3, line 6 through page 4, line 9,
5remove: all of said lines and insert:
6     Section 3.  Effective July 1, 2008, sections 627.730,
7627.731, 627.732, 627.733, 627.734, 627.736, 627.737, 627.739,
8627.7401, 627.7403, and 627.7405, Florida Statutes, constituting
9the Florida Motor Vehicle No-Fault Law, are repealed unless
10reviewed and reenacted by the Legislature before that date.
11     Section 4.  Effective July 1, 2008, section 324.023,
12Florida Statutes, is created to read:
13     324.023  Financial responsibility for bodily injury or
14death.--Every owner of a motor vehicle that is required to be
15registered in this state and every operator of any motor vehicle
16located within this state shall establish and maintain, by one
17of the methods established in s. 324.031, the ability to respond
18in damages for liability on account of accidents arising out of
19the use of the motor vehicle in at least the amounts prescribed
20in s. 324.021(7)(a) and (b). This section does not apply to any
21motor vehicle that has been continuously and exclusively used
22for a commercial purpose since being acquired by its current
23owner. The requirement of this section shall be in addition to
24any other financial responsibility required of the owner of a
25motor vehicle.
26     Section 5.  Section 19 of chapter 2003-411, Laws of
27Florida, is repealed, and sections 627.730, 627.731, 627.732,
28627.733, 627.734, 627.736, 627.737, 627.739, 627.7401, 627.7403,
29and 627.7405, Florida Statutes, are reenacted and shall not
30stand repealed on October 1, 2007, as provided for in that
31section.
32     Section 6.  The sum of $2,398,278 is appropriated from the
33Insurance Regulatory Trust Fund to the Department of Financial
34Services and 30 full-time equivalent positions with 1,387,860 in
35associated salary rate are authorized as senior insurance fraud
36investigators in the Division of Insurance Fraud of the
37Department of Financial Services. Personnel appointed to these
38positions must be certified law enforcement officers. These
39positions shall be included within the certified law enforcement
40collective bargaining unit and shall have a minimum annual
41salary of $46,262.
42     Section 7.  The sum of $408,000 is appropriated from the
43Insurance Regulatory Trust Fund to the Department of Financial
44Services for purposes of enforcing the Florida Motor Vehicle No-
45Fault Law in Miami, Orlando, and Tampa. These funds shall be
46transferred to the Justice Administrative Commission.
47     Section 8.  The sum of $408,000 is appropriated from the
48Grants and Donations Trust Fund to the Justice Administrative
49Commission and six full-time equivalent positions with 270,000
50in associated salary rate are authorized for purposes of
51enforcing the Florida Motor Vehicle No-Fault Law in Miami,
52Orlando, and Tampa.
53     Section 9.  Except as otherwise expressly provided in this
54act, this act shall take effect July 1, 2007.
