| 6 | Section 3. Effective July 1, 2008, sections 627.730, |
| 7 | 627.731, 627.732, 627.733, 627.734, 627.736, 627.737, 627.739, |
| 8 | 627.7401, 627.7403, and 627.7405, Florida Statutes, constituting |
| 9 | the Florida Motor Vehicle No-Fault Law, are repealed unless |
| 10 | reviewed and reenacted by the Legislature before that date. |
| 11 | Section 4. Effective July 1, 2008, section 324.023, |
| 12 | Florida Statutes, is created to read: |
| 13 | 324.023 Financial responsibility for bodily injury or |
| 14 | death.--Every owner of a motor vehicle that is required to be |
| 15 | registered in this state and every operator of any motor vehicle |
| 16 | located within this state shall establish and maintain, by one |
| 17 | of the methods established in s. 324.031, the ability to respond |
| 18 | in damages for liability on account of accidents arising out of |
| 19 | the use of the motor vehicle in at least the amounts prescribed |
| 20 | in s. 324.021(7)(a) and (b). This section does not apply to any |
| 21 | motor vehicle that has been continuously and exclusively used |
| 22 | for a commercial purpose since being acquired by its current |
| 23 | owner. The requirement of this section shall be in addition to |
| 24 | any other financial responsibility required of the owner of a |
| 25 | motor vehicle. |
| 26 | Section 5. Section 19 of chapter 2003-411, Laws of |
| 27 | Florida, is repealed, and sections 627.730, 627.731, 627.732, |
| 28 | 627.733, 627.734, 627.736, 627.737, 627.739, 627.7401, 627.7403, |
| 29 | and 627.7405, Florida Statutes, are reenacted and shall not |
| 30 | stand repealed on October 1, 2007, as provided for in that |
| 31 | section. |
| 32 | Section 6. The sum of $2,398,278 is appropriated from the |
| 33 | Insurance Regulatory Trust Fund to the Department of Financial |
| 34 | Services and 30 full-time equivalent positions with 1,387,860 in |
| 35 | associated salary rate are authorized as senior insurance fraud |
| 36 | investigators in the Division of Insurance Fraud of the |
| 37 | Department of Financial Services. Personnel appointed to these |
| 38 | positions must be certified law enforcement officers. These |
| 39 | positions shall be included within the certified law enforcement |
| 40 | collective bargaining unit and shall have a minimum annual |
| 41 | salary of $46,262. |
| 42 | Section 7. The sum of $408,000 is appropriated from the |
| 43 | Insurance Regulatory Trust Fund to the Department of Financial |
| 44 | Services for purposes of enforcing the Florida Motor Vehicle No- |
| 45 | Fault Law in Miami, Orlando, and Tampa. These funds shall be |
| 46 | transferred to the Justice Administrative Commission. |
| 47 | Section 8. The sum of $408,000 is appropriated from the |
| 48 | Grants and Donations Trust Fund to the Justice Administrative |
| 49 | Commission and six full-time equivalent positions with 270,000 |
| 50 | in associated salary rate are authorized for purposes of |
| 51 | enforcing the Florida Motor Vehicle No-Fault Law in Miami, |
| 52 | Orlando, and Tampa. |
| 53 | Section 9. Except as otherwise expressly provided in this |
| 54 | act, this act shall take effect July 1, 2007. |
