| 5 | On page 20, following line 31, insert: |
| 6 | Section 4. Recognizing that a term contract consistent |
| 7 | with the requirements of ss. 255.25(3) and 255.249(6), Florida |
| 8 | Statutes, cannot be competitively established prior to July 1, |
| 9 | 2007, and notwithstanding any provision of law to the contrary, |
| 10 | between July 1, 2007 and October 15, 2007, with the prior |
| 11 | written approval of the Department of Management Services, an |
| 12 | agency may use the services of a tenant broker currently under |
| 13 | contract with the department notwithstanding that such contract |
| 14 | was procured prior to March 1, 2007. After July 1, 2007, funds |
| 15 | generated through the payment of commissions by third-party |
| 16 | landlords shall be deposited into a trust fund of the Department |
| 17 | of Management Services and distributed to the tenant broker |
| 18 | through the appropriations process provided for in s. |
| 19 | 255.249(6), Florida Statutes, or other provision of law. This |
| 20 | section shall not be construed to abrogate any existing contract |
| 21 | between the department and a tenant broker, and is intended to |
| 22 | clarify the procedure for payment to the tenant broker, for |
| 23 | commissions earned through successfully completed transactions |
| 24 | under a contract procured prior to March 1, 2007. |
