  1                      A bill to be entitled

  2         An act relating to sand source management;

  3         creating s. 161.144, F.S.; providing for the

  4         development and maintenance of an inventory of

  5         identified offshore sand sources by the

  6         Department of Environmental Protection as part

  7         of its comprehensive long-term beach management

  8         plan; providing for public review of maps of

  9         offshore sand sources; providing for boards of

10         county commissioners of coastal counties

11         adjacent to sand sources proposed for use

12         outside of the region or subregion to be

13         notified and given adequate opportunity to

14         comment during a project's planning and

15         permitting stages; providing for objections or

16         concerns of such coastal counties to be noted

17         by the department and transmitted to the

18         Legislature before funding considerations or

19         before final regulatory action; providing an

20         effective date.

22  Be It Enacted by the Legislature of the State of Florida:

23  

24         Section 1.  Section 161.144, Florida Statutes, is

25  created to read:

26         161.144  Policy guidance related to sand source

27  management.--The Legislature recognizes that beach-quality

28  sand for the nourishment of the state's critically eroded

29  beaches is an exhaustible resource, in ever-decreasing supply,

30  and must be carefully managed for the systemwide benefit of

31  the state's beaches. Therefore, the Department of

 1  Environmental Protection, pursuant to s. 161.161 and in

 2  cooperation with federal and local government agencies, shall

 3  develop and maintain an inventory of identified offshore sand

 4  sources as part of the regional elements of its comprehensive

 5  long-term beach management plan. Offshore sand sources in

 6  state or federal waters which are identified for potential,

 7  proposed, or permitted use shall be clearly mapped or

 8  otherwise noted and readily available for public review. In

 9  addition, boards of county commissioners of coastal counties

10  adjacent to sand sources proposed for use outside of the

11  region or subregion shall be provided written notice and an

12  opportunity to comment during a specific project's planning

13  and permitting stages. Any unresolved objections or concerns

14  of such coastal counties shall be duly noted by the department

15  and transmitted to the Legislature before it considers state

16  funding for a project or before regulatory action is taken if

17  legislative funding precedes approval of the use of specific

18  sand sources.

19         Section 2.  This act shall take effect October 1, 2007.

22                          SENATE SUMMARY

23    Provides for the development and maintenance of an
      inventory of identified offshore sand sources by the
24    Department of Environmental Protection as part of its
      comprehensive long-term beach management plan. Provides
25    for public review of maps of offshore sand sources.
      Provides for coastal counties adjacent to sand sources
26    proposed for use outside of the region or subregion to be
      notified and given adequate opportunity to comment during
