  2         An act relating to trespass; amending s.

  3         810.011, F.S.; revising requirements for

  4         posting land; defining the term "construction

  5         site" for specified purposes; amending s.

  6         810.09, F.S.; revising provisions relating to

  7         trespassing on a construction site; providing

  8         an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Paragraph (a) of subsection (5) of section

13  810.011, Florida Statutes, is amended, and subsection (13) is

14  added to that section, to read:

15         810.011  Definitions.--As used in this chapter:

16         (5)(a)  "Posted land" is that land upon which signs are

17  placed not more than 500 feet apart along, and at each corner

18  of, the boundaries of the land, upon which signs there appears

19  prominently, in letters of not less than 2 inches in height,

20  the words "no trespassing" and in addition thereto the name of

21  the owner, lessee, or occupant of said land. Said signs shall

22  be placed along the boundary line of posted land in a manner

23  and in such position as to be clearly noticeable from outside

24  the boundary line. However, a property less than 1 acre in

25  size needs only one such sign along one of its boundaries.

26         (13)  "Construction site" means any property upon which

27  there is construction that is subject to building permit

28  posting requirements.

29         Section 2.  Paragraph (d) of subsection (2) of section

30  810.09, Florida Statutes, is amended to read:

 1         810.09  Trespass on property other than structure or

 2  conveyance.--

 3         (2)

 4         (d)  The offender commits a felony of the third degree,

 5  punishable as provided in s. 775.082, s. 775.083, or s.

 6  775.084, if the property trespassed is a construction site

 7  that is legally posted and identified in substantially the

 8  following manner: "THIS AREA IS A DESIGNATED CONSTRUCTION

 9  SITE, AND ANYONE WHO TRESPASSES ON THIS PROPERTY COMMITS A

10  FELONY."

11         Section 3.  This act shall take effect July 1, 2007.
