3 99.092, F.S.; requiring a write-in candidate
4 who seeks to qualify for nomination or election
5 to any office to pay a qualifying fee;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Section 99.092, Florida Statutes, is
11 amended to read:
12 99.092 Qualifying fee of candidate; notification of
13 Department of State.--
14 (1)(a) Each person seeking to qualify for nomination
15 or election to any office, except a person seeking to qualify
16 by the petition process pursuant to s. 99.095 and except a
17 person seeking to qualify as a write-in candidate, shall pay a
18 qualifying fee, which shall consist of a filing fee and
19 election assessment, to the officer with whom the person
20 qualifies, and any party assessment levied, and shall attach
21 the original or signed duplicate of the receipt for his or her
22 party assessment or pay the same, in accordance with the
23 provisions of s. 103.121, at the time of filing his or her
24 other qualifying papers. The amount of the filing fee is 3
25 percent of the annual salary of the office. The amount of the
26 election assessment is 1 percent of the annual salary of the
27 office sought. The election assessment shall be deposited into
28 the Elections Commission Trust Fund. The amount of the party
29 assessment is 2 percent of the annual salary. The annual
30 salary of the office for purposes of computing the filing fee,
31 election assessment, and party assessment shall be computed by

1 multiplying 12 times the monthly salary, excluding any special
2 qualification pay, authorized for such office as of July 1
3 immediately preceding the first day of qualifying.
4 (b) Each person seeking to qualify for nomination or
5 election to any office as a write-in candidate, except a
6 person seeking to qualify by the petition process pursuant to
7 s. 99.095, shall pay a qualifying fee that is 3 percent of the
8 annual salary for the office sought.
9 (c) A No qualifying fee may not shall be returned to
10 the candidate unless the candidate withdraws his or her
11 candidacy before the last date to qualify. If a candidate dies
12 before prior to an election and has not withdrawn his or her
13 candidacy before the last date to qualify, the candidate's
14 qualifying fee shall be returned to his or her designated
15 beneficiary, and, if the filing fee or any portion thereof has
16 been transferred to the political party of the candidate, the
17 Secretary of State shall direct the party to return that
18 portion to the designated beneficiary of the candidate.
19 (2) The supervisor of elections shall, immediately
20 after the last day for qualifying, submit to the Department of
21 State a list containing the names, party affiliations, and
22 addresses of all candidates and the offices for which they
23 qualified.
24 Section 2. This act shall take effect upon becoming a
25 law.
