  1                      A bill to be entitled

  2         An act relating to criminal street gangs;

  3         amending s. 874.06, F.S.; permitting

  4         municipalities to bring civil actions for

  5         certain violations; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 874.06, Florida Statutes, is

11  amended to read:

12         874.06  Civil cause of action.--A person, municipality,

13  or organization establishing, by clear and convincing

14  evidence, coercion, intimidation, threats, or other harm to

15  that person, municipality, or organization in violation of

16  this chapter has a civil cause of action for treble damages,

17  an injunction, or any other appropriate relief in law or

18  equity. Upon prevailing, the plaintiff may recover reasonable

19  attorney's fees and costs.

20         Section 2.  This act shall take effect July 1, 2007.
