1 A bill to be entitled
2 An act relating to criminal street gangs;
3 creating s. 874.10, F.S.; creating the Gang
4 Resistance Education and Training Program;
5 providing objectives, providing duties for the
6 Department of Juvenile Justice, in conjunction
7 with specified agencies, concerning the
8 program; creating s. 874.11, F.S.; prohibiting
9 the purchase or possession of firearms by
10 criminal street gang members; providing
11 penalties; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 874.10, Florida Statutes, is
16 created to read:
17 874.10 Gang Resistance Education and Training
18 Program.--
19 (1) There is hereby established the Gang Resistance
20 Education and Training Program to be administered by the
21 Department of Juvenile Justice and implemented to the extent
22 funded by law. The program shall operate through formal
23 agreements between law enforcement and education agencies. The
24 primary objectives of the program are to prevent gang
25 membership and the delinquency and violence associated with
26 gang activity. At a minimum, the program shall be designed to:
27 (a) Provide children with the skills necessary to
28 combat the stresses that set the stage for gang involvement.
29 (b) Provide children with accurate knowledge about
30 gang involvement.

1 (c) Provide children with the skills to resolve
2 conflicts without resorting to violence.
3 (d) Help build rapport between the children and law
4 enforcement officers.
5 (2) In conjunction with the Department of Education
6 and the Department of Law Enforcement, the Department of
7 Juvenile Justice shall:
8 (a) Develop a curriculum-based program designed to
9 instruct students in the life skills necessary to avoid gang
10 involvement, violence, and drug abuse. The program should
11 include a middle school component, an elementary school
12 curriculum, a summer program, and training for families.
13 (b) Develop and implement a program to train law
14 enforcement officers as program instructors, including
15 guidelines for selecting officers to participate in the
16 program.
17 (c) Adopt the necessary officer participation form,
18 agency commitment form, and other forms necessary to implement
19 the program.
20 (d) Adopt rules for the disbursement of any available
21 grant funds.
22 Section 2. Section 874.11, Florida Statutes, is
23 created to read:
24 874.11 Purchase or possession of firearms.--
25 (1) A criminal street gang member who purchases a
26 firearm as defined in s. 790.001 commits a felony of the third
27 degree, punishable as provided in s. 775.082, s. 775.083, or
28 s. 775.084.
29 (2) A criminal street gang member who possesses a
30 firearm as defined in s. 790.001 commits a felony of the third

1 degree, punishable as provided in s. 775.082, s. 775.083, or
2 s. 775.084.
3 Section 3. This act shall take effect July 1, 2007.
