12 Appropriations (Diaz de la Portilla) recommended the following
13 amendment:

16 On page 26, between lines 30 and 31,

18 insert:
19 Section 18. Subsection (4) of section 338.231, Florida
20 Statutes, is amended to read:
21 338.231 Turnpike tolls, fixing; pledge of tolls and
22 other revenues.--The department shall at all times fix,
23 adjust, charge, and collect such tolls for the use of the
24 turnpike system as are required in order to provide a fund
25 sufficient with other revenues of the turnpike system to pay
26 the cost of maintaining, improving, repairing, and operating
27 such turnpike system; to pay the principal of and interest on
28 all bonds issued to finance or refinance any portion of the
29 turnpike system as the same become due and payable; and to
30 create reserves for all such purposes.
31 (4) For the period July 1, 1998, through June 30, 2017

1 2007, the department shall, to the maximum extent feasible,
2 program sufficient funds in the tentative work program such
3 that the percentage of turnpike toll and bond financed
4 commitments in Dade County, Broward County, and Palm Beach
5 County as compared to total turnpike toll and bond financed
6 commitments shall be at least 90 percent of the share of net
7 toll collections attributable to users of the turnpike system
8 in Dade County, Broward County, and Palm Beach County as
9 compared to total net toll collections attributable to users
10 of the turnpike system. The requirements of this subsection do
11 not apply when the application of such requirements would
12 violate any covenant established in a resolution or trust
13 indenture relating to the issuance of turnpike bonds.

20 On page 4, line 3, after the semicolon,

22 insert:
23 amending s. 338.213, F.S.; extending a period
24 in which a specified percentage of toll and
25 bond financed commitments in Dade, Broward, and
26 Palm Beach Counties must be a specific
27 percentage of toll collections from turnpike
28 usage in those counties;
