| 2 | An act relating to the Pari-mutuel Wagering Trust Fund; |
| 3 | amending s. 550.135, F.S.; providing for the use of |
| 4 | certain funds received from the regulation of slot machine |
| 5 | facilities; requiring that unappropriated funds in excess |
| 6 | of incurred obligations and funds necessary for cash flow |
| 7 | in the subsequent year be deposited into the General |
| 8 | Revenue Fund at the end of the fiscal year; providing an |
| 9 | effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Subsection (2) of section 550.135, Florida |
| 14 | Statutes, is amended, and subsection (3) is added to that |
| 15 | section, to read: |
| 16 | 550.135 Division of moneys derived under this law.--All |
| 17 | moneys that are deposited with the Chief Financial Officer to |
| 18 | the credit of the Pari-mutuel Wagering Trust Fund shall be |
| 19 | distributed as follows: |
| 20 | (2) All unappropriated funds in excess of $1.5 million in |
| 21 | the Pari-mutuel Wagering Trust Fund, collected pursuant to this |
| 22 | chapter, shall be deposited with the Chief Financial Officer to |
| 23 | the credit of the General Revenue Fund. |
| 24 | (3) The slot machine license fee, the slot machine |
| 25 | occupational license fee, and the compulsive or addictive |
| 26 | gambling prevention program fee collected pursuant to ss. |
| 27 | 551.106, 551.107(2)(a)1., and 551.118 shall be used to fund the |
| 28 | direct and indirect operating expenses of the division's slot |
| 29 | machine regulation operations and to provide funding for |
| 30 | relevant enforcement activities in accordance with authorized |
| 31 | appropriations. Funds deposited into the Pari-mutuel Wagering |
| 32 | Trust Fund pursuant to ss. 551.106, 551.107(2)(a)1., and 551.118 |
| 33 | shall be reserved in the trust fund for slot machine regulation |
| 34 | operations. On June 30, any unappropriated funds in excess of |
| 35 | those necessary for incurred obligations and subsequent year |
| 36 | cash flow for slot machine regulation operations shall be |
| 37 | deposited with the Chief Financial Officer to the credit of the |
| 38 | General Revenue Fund. |
| 39 | Section 2. This act shall take effect upon becoming a law. |
