A bill to be entitled
2An act relating to the distribution of documentary stamp
3taxes; amending s. 201.15, F.S.; deleting a provision
4relating to distribution of proceeds from the excise tax
5on documents to the Public Education Capital Outlay and
6Debt Service Trust Fund; amending s. 1013.64, F.S.;
7deleting provisions relating to distributions from such
8trust fund for specified programs; amending s. 1013.65,
9F.S.; deleting reference to certain moneys paid into such
10trust fund and to moneys set aside for distribution to a
11specified program; amending s. 1013.738, F.S.; deleting a
12provision relating to distributions from such trust fund
13for a specified program; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Paragraph (d) of subsection (1) of section
18201.15, Florida Statutes, is amended to read:
19     201.15  Distribution of taxes collected.--All taxes
20collected under this chapter shall be distributed as follows and
21shall be subject to the service charge imposed in s. 215.20(1),
22except that such service charge shall not be levied against any
23portion of taxes pledged to debt service on bonds to the extent
24that the amount of the service charge is required to pay any
25amounts relating to the bonds:
26     (1)  Sixty-two and sixty-three hundredths percent of the
27remaining taxes collected under this chapter shall be used for
28the following purposes:
29     (d)  The remainder of the moneys distributed under this
30subsection, after the required payments under paragraphs (a),
31(b), and (c), shall be paid into the State Treasury to the
32credit of:
33     1.  The State Transportation Trust Fund in the Department
34of Transportation in the amount of $541.75 million in each
35fiscal year, to be paid in quarterly installments and used for
36the following specified purposes, notwithstanding any other law
37to the contrary:
38     a.  For the purposes of capital funding for the New Starts
39Transit Program, authorized by Title 49, U.S.C. s. 5309 and
40specified in s. 341.051, 10 percent of these funds;
41     b.  For the purposes of the Small County Outreach Program
42specified in s. 339.2818, 5 percent of these funds;
43     c.  For the purposes of the Strategic Intermodal System
44specified in ss. 339.61, 339.62, 339.63, and 339.64, 75 percent
45of these funds after allocating for the New Starts Transit
46Program described in sub-subparagraph a. and the Small County
47Outreach Program described in sub-subparagraph b.; and
48     d.  For the purposes of the Transportation Regional
49Incentive Program specified in s. 339.2819, 25 percent of these
50funds after allocating for the New Starts Transit Program
51described in sub-subparagraph a. and the Small County Outreach
52Program described in sub-subparagraph b.
53     2.  The Water Protection and Sustainability Program Trust
54Fund in the Department of Environmental Protection in the amount
55of $100 million in each fiscal year, to be paid in quarterly
56installments and used as required by s. 403.890.
57     3.  The Public Education Capital Outlay and Debt Service
58Trust Fund in the Department of Education in the amount of $105
59million in each fiscal year, to be paid in monthly installments
60with $75 million used to fund the Classrooms for Kids Program
61created in s. 1013.735, and $30 million to be used to fund the
62High Growth County District Capital Outlay Assistance Grant
63Program created in s. 1013.738. If required, new facilities
64constructed under the Classrooms for Kids Program must meet the
65requirements of s. 1013.372.
66     3.4.  The Grants and Donations Trust Fund in the Department
67of Community Affairs in the amount of $3.25 million in each
68fiscal year to be paid in monthly installments, with $3 million
69to be used to fund technical assistance to local governments and
70school boards on the requirements and implementation of this act
71and $250,000 to be used to fund the Century Commission
72established in s. 163.3247.

74Moneys distributed pursuant to this paragraph may not be pledged
75for debt service unless such pledge is approved by referendum of
76the voters.
77     Section 2.  Subsection (7) of section 1013.64, Florida
78Statutes, is amended to read:
79     1013.64  Funds for comprehensive educational plant needs;
80construction cost maximums for school district capital
81projects.--Allocations from the Public Education Capital Outlay
82and Debt Service Trust Fund to the various boards for capital
83outlay projects shall be determined as follows:
84     (7)  Moneys distributed to the Public Education Capital
85Outlay and Debt Service Trust Fund pursuant to s. 201.15(1)(d)
86to fund the Classrooms for Kids Program created in s. 1013.735
87and the High Growth County District Capital Outlay Assistance
88Grant Program created in s. 1013.738 shall be distributed as
89provided by those sections.
90     Section 3.  Paragraph (a) of subsection (2) of section
911013.65, Florida Statutes, is amended to read:
92     1013.65  Educational and ancillary plant construction
93funds; Public Education Capital Outlay and Debt Service Trust
94Fund; allocation of funds.--
95     (2)(a)  The Public Education Capital Outlay and Debt
96Service Trust Fund shall be comprised of the following sources,
97which are hereby appropriated to the trust fund:
98     1.  Proceeds, premiums, and accrued interest from the sale
99of public education bonds and that portion of the revenues
100accruing from the gross receipts tax as provided by s. 9(a)(2),
101Art. XII of the State Constitution, as amended, interest on
102investments, and federal interest subsidies.
103     2.  General revenue funds appropriated to the fund for
104educational capital outlay purposes.
105     3.  All capital outlay funds previously appropriated and
106certified forward pursuant to s. 216.301.
107     4.a.  Funds paid pursuant to s. 201.15(1)(d).
108     b.  The sum of $41.75 million of such funds shall be
109appropriated annually for expenditure to fund the Classrooms for
110Kids Program created in s. 1013.735 and shall be distributed as
111provided by that section.
112     Section 4.  Subsection (4) of section 1013.738, Florida
113Statutes, is amended to read:
114     1013.738  High Growth District Capital Outlay Assistance
115Grant Program.--
116     (4)  Moneys distributed to the Public Education Capital
117Outlay and Debt Service Trust Fund pursuant to s. 201.15(1)(d)
118for the High Growth District Capital Outlay Assistance Grant
119Program created in this section shall be distributed as provided
120by this section.
121     Section 5.  This act shall take effect July 1, 2007.
