| 3 | Sunset Review Act regarding building plans and blueprints |
| 4 | of structures and facilities owned or operated by a state |
| 5 | agency; amending s. 119.071, F.S., which provides an |
| 6 | exemption from public records requirements for building |
| 7 | plans, blueprints, schematic drawings, and diagrams which |
| 8 | depict the internal layout and structural elements of a |
| 9 | building, arena, stadium, water treatment facility, or |
| 10 | other structure owned or operated by an agency; |
| 11 | reorganizing the exemption; removing the scheduled repeal |
| 12 | of the exemption under the Open Government Sunset Review |
| 13 | Act; providing an effective date. |

| 15 | Be It Enacted by the Legislature of the State of Florida: |
| 16 |
|
| 17 | Section 1. Paragraph (b) of subsection (3) of section |
| 18 | 119.071, Florida Statutes, is amended to read: |
| 19 | 119.071 General exemptions from inspection or copying of |
| 20 | public records.-- |
| 21 | (3) SECURITY.-- |
| 22 | (b)1. Building plans, blueprints, schematic drawings, and |
| 23 | diagrams, including draft, preliminary, and final formats, which |
| 24 | depict the internal layout and structural elements of a |
| 25 | building, arena, stadium, water treatment facility, or other |
| 26 | structure owned or operated by an agency are exempt from s. |
| 27 | 119.07(1) and s. 24(a), Art. I of the State Constitution. |
| 28 | 2. This exemption applies to building plans, blueprints, |
| 29 | schematic drawings, and diagrams, including draft, preliminary, |
| 30 | and final formats, which depict the internal layout and |
| 31 | structural elements of a building, arena, stadium, water |
| 32 | treatment facility, or other structure owned or operated by an |
| 33 | agency before, on, or after the effective date of this act. |
| 34 | 3. Information made exempt by this paragraph may be |
| 35 | disclosed: |
| 36 | a. To another governmental entity if disclosure is |
| 37 | necessary for the receiving entity to perform its duties and |
| 38 | responsibilities; |
| 39 | b. To a licensed architect, engineer, or contractor who is |
| 40 | performing work on or related to the building, arena, stadium, |
| 41 | water treatment facility, or other structure owned or operated |
| 42 | by an agency; or |
| 43 | c. Upon a showing of good cause before a court of |
| 44 | competent jurisdiction. |
| 45 | 4. The entities or persons receiving such information |
| 46 | shall maintain the exempt status of the information. This |
| 47 | paragraph is subject to the Open Government Sunset Review Act in |
| 48 | accordance with s. 119.15 and shall stand repealed on October 2, |
| 49 | 2007, unless reviewed and reenacted by the Legislature. |
| 50 | Section 2. This act shall take effect October 1, 2007. |
