3     Amendment (with title amendment)
4     Between lines 3465 and 3466, insert:
5     Section 52.  Department of Transportation study of
6transportation facilities providing access to Indian
7reservations; report and recommendations authorized.--
8     (1)  The Department of Transportation is directed to
9conduct a study of the impacts that legalized gambling and other
10activities on Indian reservation lands are having on public
11roads and other transportation facilities, regarding traffic
12congestion and other mobility issues, facility maintenance and
13repair costs, emergency evacuation readiness, costs of potential
14future widening or other improvements, and other impacts on the
15motoring, nongaming public.
16     (2)  The study shall include, but is not limited to, the
17following information:
18     (a)  A listing, description, and functional classification
19of the access roads to and from each Indian reservation in the
20state.
21     (b)  An identification of these access roads that either
22are scheduled for improvements within the department's 5-year
23Work Program, or are listed on the department's or a
24metropolitan planning organization's 20-year, long-range
25transportation plan.
26     (c)  The most recent traffic counts on the access roads and
27projected future usage, as well as any projections of impacts on
28secondary, feeder, or connector roads, interstate highway exit
29and entrance ramps, or other area transportation facilities.
30     (d)  The safety and maintenance ratings of each access road
31and a detailed review of impacts on local and state emergency
32management agencies to provide emergency or evacuation services.
33     (e)  The estimated infrastructure costs to maintain,
34improve, or widen these access roads based on future projected
35needs.
36     (f)  The feasibility of implementing tolls on these access
37roads or, if already tolled, raising the toll to offset and
38mitigate the impacts of traffic generated by Indian reservation
39gaming activities on nontribal communities in the state and to
40finance projected future improvements to the access roads.
41     (3)  The department shall present its findings and
42recommendations in a report to be submitted to the Governor, the
43President of the Senate, and the Speaker of the House of
44Representatives by January 15, 2008. The report may include
45department recommendations for proposed legislation.

49     Remove line 266 and insert:
50purposes; directing the Department of Transportation to conduct
51a study on the access roads to pari-mutuel facilities and Indian
52reservation lands where gaming activities occur; providing for
53the content of the study; requiring a report to the Governor and
54the Legislature; providing an effective date.
