| 5 | Section 29. Subsection (12) is added to section 1011.62, |
| 6 | Florida Statutes, to read: |
| 7 | 1011.62 Funds for operation of schools.--If the annual |
| 8 | allocation from the Florida Education Finance Program to each |
| 9 | district for operation of schools is not determined in the |
| 10 | annual appropriations act or the substantive bill implementing |
| 11 | the annual appropriations act, it shall be determined as |
| 12 | follows: |
| 13 | (12) FUNDING.-- |
| 14 | (a) Any reduction in FEFP K-12 operational funds from |
| 15 | 2007-2008 per FTE levels adjusted by the 12-month percentage |
| 16 | change in the Consumer Price Index for All Urban Consumers, U.S. |
| 17 | City Average, All Items, or successor reports as reported by the |
| 18 | United States Department of Labor, Bureau of Labor Statistics, |
| 19 | or its successor for December of the previous year, shall |
| 20 | require an affirmative vote of at least two-thirds of the |
| 21 | membership of each house of the Legislature. |
| 22 | (b) The statewide required local effort millage rate, |
| 23 | based on the official school ad valorem tax base estimates |
| 24 | available at the time the General Appropriations Act is passed |
| 25 | by the Legislature, shall not be increased from the prior fiscal |
| 26 | year for school districts except by an affirmative vote of at |
| 27 | least two-thirds of the membership of each house of the |
| 28 | Legislature. |
| 29 | Section 30. If any law that is amended by this act was |
| 30 | also amended by a law enacted during the 2007 Regular Session or |
| 31 | any 2007 special session of the Legislature, such laws shall be |
| 32 | construed as if they had been enacted during the same session of |
| 33 | the Legislature, and full effect should be given to each if that |
| 34 | is possible. |
| 35 | Section 31. Except as otherwise expressly provided in this |
| 36 | act, this act and section 30 of this act shall take effect upon |
| 37 | becoming a law, sections 13 through 29 of this act shall take |
| 38 | effect only upon the effective date of amendments to the State |
| 39 | Constitution contained in Senate Joint Resolution 4B or House |
| 40 | Joint Resolution 3B revising the homestead tax exemption and |
| 41 | providing an exemption from ad valorem taxation for tangible |
| 42 | personal property and property used for workforce and affordable |
| 43 | rental housing, and sections 13 through 29 of this act shall |
| 44 | apply retroactively to the 2008 tax roll. |
