13         Senate Amendment (with title amendment) 
14         On page 17, lines 19-26, delete those lines
15  
16  and insert:  
17         Section 4.  Section 129.065, Florida Statutes, is
18  created to read:
19         129.065  Certain reductions in allocations prohibited
20  without unanimous vote.--
21         (1)  A county, or a municipal service taxing unit,
22  dependent special district, or independent special district
23  within a county, may not reduce the amount it allocates for
24  law enforcement services, firefighting services, or emergency
25  medical services within its service area below the amount
26  allocated for such services in the prior fiscal year unless
27  such reduction is approved by a unanimous vote of the
28  governing authority of the county, municipal service taxing
29  unit, dependent district, or independent district.
30         (2)  A county shall forfeit its distribution of the
31  local government half-cent sales tax revenues during the 12

 1  months following a vote taken in violation of this section by
 2  the county or by a municipal service taxing unit, dependent
 3  special district, or independent special district within that
 4  county.
 5         (3)  The Department of Revenue shall enforce compliance
 6  with this section.
 7         Section 5.  Section 166.243, Florida Statutes, is
 8  created to read:
 9         166.243  Certain reductions in allocations prohibited
10  without unanimous vote.--
11         (1)  The governing authority of a municipality or
12  special district dependent thereto may not reduce the amount
13  it allocates for law enforcement services, firefighting
14  services, or emergency medical services within its service
15  area below the amount allocated for such services in the prior
16  fiscal year unless such reduction is approved by a unanimous
17  vote of the governing authority of the municipality or special
18  district dependent thereto.
19         (2)  A municipality shall forfeit its distribution of
20  the local government half-cent sales tax revenues during the
21  12 months following a vote taken in violation of this section.
22         (3)  The Department of Revenue shall enforce compliance
23  with this section.
24         Section 6.  Subsection (3) is added to section 218.63,
25  Florida Statutes, to read:
26         218.63  Participation requirements.--
27         (3)  A county or municipality may not participate in
28  the distribution of local government half-cent sales tax
29  revenues during the 12 months following a determination of
30  noncompliance by the Department of Revenue as provided in s.
31  200.065(13)(e), or following a violation of s. 129.065 with

 2  to a municipality.

 3         municipality from participating in the

 8         district within the county or municipality
 9         levies taxes in excess of the maximum aggregate
10         taxes permitted by law or reduces its
11         allocation for law enforcement, fire, or
12         emergency medical services;
