| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Section 1 of chapter 98-521, Laws of Florida, |
| 12 | is amended to read: |
| 13 | Section 1. There is hereby created the South Broward |
| 14 | Utility Advisory Board, which shall be an advisory board of the |
| 15 | City of Sunrise. The board shall be composed of seven members, |
| 16 | as follows: two members shall be appointed by the City of |
| 17 | Sunrise, two members shall be appointed by the Town of Davie, |
| 18 | one member shall be appointed by the City of Pembroke Pines, and |
| 19 | two members shall be appointed by the Town of Southwest Ranches |
| 20 | Broward County Commission. Each appointed member shall be a |
| 21 | water and sewer user within the service area of the former South |
| 22 | Broward Utility. Terms of each member shall be for 2 years, |
| 23 | except that all appointments and retention of board members |
| 24 | shall be at the sole discretion of the appointing authorities. |
| 25 | (1) The responsibility of the board shall be to review and |
| 26 | advise the City of Sunrise regarding any proposed change by the |
| 27 | city to the water and sewer rates charged within the area which |
| 28 | was formerly the South Broward Utility service area. In the |
| 29 | event of a proposed rate change within such area, the South |
| 30 | Broward Utility Advisory Board may require the City of Sunrise |
| 31 | to hire a rate consultant to advise the city regarding such |
| 32 | proposed rate change. |
| 33 | (2) Within 30 days following notice of a rate change, the |
| 34 | advisory board shall present a report of its findings to the |
| 35 | Commission of the City of Sunrise. If presented within the 30- |
| 36 | day period, the report shall be considered by the commission |
| 37 | before rates may be altered or changed within the area formerly |
| 38 | served by the South Broward Utility. |
| 39 | (3) The City of Sunrise shall appropriate not more than |
| 40 | $25,000 annually for a rate consultant for the South Broward |
| 41 | Utility Advisory Board, as provided in subsection (1). |
| 42 | (4) The advisory board shall have no legal standing to |
| 43 | bring any legal action. |
| 44 | (5) The City of Sunrise shall, by ordinance, provide for |
| 45 | such other procedures and regulations which are not in conflict |
| 46 | with this act as are necessary for the continued operation of |
| 47 | the board. |
| 48 | Section 2. This act shall take effect upon becoming a law. |
