| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |
|
| 11 | Section 1. Section 376.30715, Florida Statutes, is amended |
| 12 | to read: |
| 13 | 376.30715 Innocent victim petroleum storage system |
| 14 | restoration.--A contaminated site acquired by the current owner |
| 15 | prior to July 1, 1990, which has ceased operating as a petroleum |
| 16 | storage or retail business prior to January 1, 1985, is eligible |
| 17 | for financial assistance pursuant to s. 376.305(6), |
| 18 | notwithstanding s. 376.305(6)(a). For purposes of this section, |
| 19 | the term "acquired" means the acquisition of title to the |
| 20 | property; however, a subsequent transfer of the property to a |
| 21 | spouse, a surviving spouse in trust or free of trust, or a |
| 22 | revocable trust created for the benefit of the settlor does not |
| 23 | disqualify the site from financial assistance pursuant to s. |
| 24 | 376.3071(5). Eligible sites shall be ranked in accordance with |
| 25 | s. 376.3071(5). |
| 26 | Section 2. This act shall take effect July 1, 2008. |
