1Representative Zapata offered the following:

3     Amendment (with directory and title amendments)
4     Between lines 604 and 605, insert:
5     (12)  Notwithstanding the provisions of subsections (1)-
6(8), the commission shall dismiss any complaint when:
7     (a)  The complaining party filed a parallel complaint,
8arising out of a common nucleus of operative facts, with a
9county ethics commission which resulted in a finding of no
10probable cause or a final order disposing of the complaint;
11     (b)  The state law upon which the Commission on Ethics
12complaint is based is not materially different from the
13provisions of the county or municipal ordinance applied by the
14county ethics commission when resolving the parallel complaint;
15and
16     (c)  The proceedings before the county ethics commission
17regarding the parallel complaint were full and fair.

19 A county ethics commission also shall dismiss any complaint
20that meets the three criteria in this subsection.
