3     Amendment (with title amendment)
4     Between lines 70 and 71, insert:

6     Section 2.  Subsection (2) of section 112.313, Florida
7Statutes, is amended to read:
8     112.313  Standards of conduct for public officers,
9employees of agencies, and local government attorneys.--
10     (2)  SOLICITATION OR ACCEPTANCE OF GIFTS OR
11CONTRIBUTIONS.--
12     (a)  No public officer, employee of an agency, local
13government attorney, or candidate for nomination or election
14shall solicit or accept anything of value to the recipient,
15including a gift, loan, reward, promise of future employment,
16favor, or service, based upon any understanding that the vote,
17official action, or judgment of the public officer, employee,
18local government attorney, or candidate would be influenced
19thereby.
20     (b)  No elected or appointed member of a local government
21council or advisory committee shall, directly or indirectly,
22solicit any contribution on behalf of a candidate from an
23individual who is participating in a pending matter before the
24council or advisory committee. For purposes of this paragraph,
25"pending matter" means any quasi-judicial or other proceeding,
26application, request for a ruling or other determination, or
27other particular action involving a specific party or parties.  
28The prohibition in this paragraph shall not apply to the members
29of a governing body of a district, county, or municipality
30regardless of whether such members are acting in an elected or
31appointed capacity.
