| 2 | An act relating to telecommunication service contracts; |
| 3 | creating s. 364.193, F.S.; prohibiting certain |
| 4 | telecommunications service companies, without the express |
| 5 | written consent of the customer, from extending the length |
| 6 | of a customer's telecommunications contract solely because |
| 7 | the customer adds or removes any service, equipment, or |
| 8 | phone from the contract; providing an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |

| 12 | Section 1. Section 364.193, Florida Statutes, is created |
| 13 | to read: |
| 14 | 364.193 Telecommunications service contracts.--A |
| 15 | telecommunications company, as defined in s. 364.02, or a |
| 16 | commercial mobile radio services provider, as defined in 47 |
| 17 | C.F.R. s. 20.3, which provides telecommunications services and |
| 18 | requires as a condition of receiving such services that the |
| 19 | customer enter into a written telecommunications service |
| 20 | contract may not extend the length of the contract beyond the |
| 21 | initial contract period solely because the customer elects to |
| 22 | add or remove any service, equipment, or phone from the |
| 23 | telecommunications services contract. Any such contract may be |
| 24 | extended only upon the express written consent of the customer. |
| 25 | Section 2. This act shall take effect July 1, 2008. |
