| 5 | (a) For purposes of meeting the federal cost neutrality |
| 6 | requirement of 7 C.F.R. part 246, shall compare the average cost |
| 7 | of each food item redeemed by above-50-percent vendors against |
| 8 | the average cost of the same food item redeemed by regular |
| 9 | vendors. |
| 10 | (b) May not discontinue a WIC-eligible generic product |
| 11 | unless the product no longer meets the nutritional guidelines of |
| 12 | the WIC program. |
| 13 | (c) Shall only expend funds provided by the Federal |
| 14 | Government for the administration of the program. In the event |
| 15 | the department exceeds the federal funding allocation, the |
| 16 | department may submit a budget amendment to the Executive Office |
| 17 | of the Governor requesting additional trust fund authority to |
| 18 | implement the program pursuant to s. 216.181(11). |
| 19 | Section 2. Section 409.942, Florida Statutes, is amended |
| 20 | to read: |
| 21 | 409.942 Electronic benefit transfer program.-- |
| 22 | (1) The Department of Children and Family Services shall |
| 23 | establish an electronic benefit transfer program for the |
| 24 | dissemination of food stamp benefits and temporary assistance |
| 25 | payments, including refugee cash assistance payments, asylum |
| 26 | applicant payments, and child support disregard payments. If the |
| 27 | Federal Government does not enact legislation or regulations |
| 28 | providing for dissemination of supplemental security income by |
| 29 | electronic benefit transfer, the state may include supplemental |
| 30 | security income in the electronic benefit transfer program. |
| 31 | (a)(2) The department shall, in accordance with applicable |
| 32 | federal laws and regulations, develop minimum program |
| 33 | requirements and other policy initiatives for the electronic |
| 34 | benefit transfer program. |
| 35 | (b)(3) The department shall enter into public-private |
| 36 | contracts for all provisions of electronic transfer of public |
| 37 | assistance benefits. |
| 38 | (2)(4) Workforce Florida, Inc., through the Agency for |
| 39 | Workforce Innovation, shall establish an electronic benefit |
| 40 | transfer program for the use and management of education, |
| 41 | training, child care, transportation, and other program benefits |
| 42 | under its direction. The workforce electronic benefit transfer |
| 43 | program shall fulfill all federal and state requirements for |
| 44 | Individual Training Accounts, Retention Incentive Training |
| 45 | Accounts, Individual Development Accounts, and Individual |
| 46 | Services Accounts. The workforce electronic benefit transfer |
| 47 | program shall be designed to enable an individual who receives |
| 48 | an electronic benefit transfer card under subsection (1) to use |
| 49 | that card for purposes of benefits provided under the workforce |
| 50 | development system as well. The Department of Children and |
| 51 | Family Services shall assist Workforce Florida, Inc., in |
| 52 | developing an electronic benefit transfer program for the |
| 53 | workforce development system that is fully compatible with the |
| 54 | department's electronic benefit transfer program. The agency |
| 55 | shall reimburse the department for all costs incurred in |
| 56 | providing such assistance and shall pay all costs for the |
| 57 | development of the workforce electronic benefit transfer |
| 58 | program. |
| 59 | (3) By January 1, 2009, the Department of Health shall |
| 60 | submit a plan for approval by the United States Department of |
| 61 | Agriculture, Bureau of Food and Nutrition Service, for the |
| 62 | implementation of a statewide electronic benefits transfer |
| 63 | program for the dissemination of benefits under the Special |
| 64 | Supplemental Nutrition Program for Women, Infants, and Children |
| 65 | (WIC), authorized by the Child Nutrition Act. The plan shall be |
| 66 | developed in consultation with authorized WIC vendors, including |
| 67 | above-50-percent vendors. By July 1, 2010, the Department of |
