| 5 | the trust fund; providing for an annual carryforward of |

| 7 | creation of the trust fund; providing a contingent |
| 8 | effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |

| 12 | Section 1. (1) The Lead Poisoning Prevention Trust Fund |
| 13 | is created within the Department of Health. Funds credited to |
| 14 | the trust fund shall consist of fees generated from examinations |
| 15 | and certification required under the Florida Lead-based Paint |
| 16 | Reduction Program pursuant to s. 381.99, Florida Statutes. |
| 17 | (2) Notwithstanding s. 216.301, Florida Statutes, and |
| 18 | pursuant to s. 216.351, Florida Statutes, any balance in the |
| 19 | trust fund at the end of any fiscal year shall remain in the |
| 20 | fund and be available for carrying out the purposes of the trust |
| 21 | fund. |
| 22 | (3) In accordance with s. 19(f)(2), Art. III of the State |
| 23 | Constitution, the trust fund shall, unless terminated sooner, be |
| 24 | terminated on July 1, 2012. Before its scheduled termination, |
| 25 | the trust fund shall be reviewed as provided in s. 215.3206(1) |
| 26 | and (2), Florida Statutes. |
| 27 | Section 2. This act shall take effect July 1, 2008, if HB |
| 28 | 1197 or similar legislation is adopted in the same legislative |
| 29 | session or an extension thereof and becomes law. |
