A bill to be entitled
2An act relating to sexual predators and sexual offenders;
3amending ss. 775.21 and 943.0435, F.S.; requiring the
4Department of Law Enforcement to set and charge a fee to
5sexual predators and sexual offenders who are financially
6able to pay for all or part of the costs of supervision;
7authorizing a sheriff to charge a fee to a sexual predator
8or sexual offender to help defray the expense of
9registering the sexual predator or sexual offender at the
10sheriff's office; requiring the department to adopt rules;
11providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Subsections (11) and (12) are added to section
16775.21, Florida Statutes, to read:
17     775.21  The Florida Sexual Predators Act.--
18     (11)  EXPENSES.--
19     (a)  The department shall set a fee to cover the
20department's actual costs of supervision, and those sexual
21predators who are financially able shall pay all or part of the
22costs of supervision.
23     (b)  The sheriff may charge a fee to a sexual predator to
24help defray the actual expense incurred in registering the
25sexual predator at the sheriff's office.
26     (12)  RULES.--The department shall adopt rules pursuant to
27ss. 120.536(1) and 120.54 to administer this section.
28     Section 2.  Subsections (15) and (16) are added to section
29943.0435, Florida Statutes, to read:
30     943.0435  Sexual offenders required to register with the
31department; penalty.--
32     (15)(a)  The department shall set a fee to cover the
33department's actual costs of supervision, and those sexual
34offenders who are financially able shall pay all or part of the
35costs of supervision.
36     (b)  The sheriff may charge a fee to a sexual offender to
37help defray the actual expense incurred in registering the
38sexual offender at the sheriff's office.
39     (16)  The department shall adopt rules pursuant to ss.
40120.536(1) and 120.54 to administer this section.
41     Section 3.  This act shall take effect July 1, 2008.
