| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Paragraphs (ee) and (kk) of subsection (2) of |
| 13 | section 5 and paragraph (b) of subsection (5) of section 8 of |
| 14 | chapter 2001-299, Laws of Florida, are amended to read: |
| 15 | Section 5. Commission powers, mandatory and |
| 16 | discretionary.-- |
| 17 | (2) The commission has the power to: |
| 18 | (ee) Request and receive criminal history record |
| 19 | information for the purpose of screening applicants for |
| 20 | certificates and public vehicle driver's licenses and pay a fee |
| 21 | for any such record. Such record information may include a |
| 22 | national criminal history records check with the Federal Bureau |
| 23 | of Investigation. The fingerprints may be submitted by the |
| 24 | commission to the Florida Department of Law Enforcement (FDLE) |
| 25 | for state processing, and the department shall forward them to |
| 26 | the Federal Bureau of Investigation for a national criminal |
| 27 | history records check. Fingerprint searches against the |
| 28 | terrorist database must be specified as such. All costs |
| 29 | associated with transmittal and processing shall be borne by the |
| 30 | commission, the employer, or the person subject to the |
| 31 | background check. The FDLE shall invoice the commission for the |
| 32 | fingerprints submitted each month. The commission shall screen |
| 33 | background results to determine if an applicant meets licensure |
| 34 | requirements. |
| 35 | (kk) Issue, or authorize its director, or any interim |
| 36 | director, to issue and reissue, for good cause and without the |
| 37 | necessity of notice or public hearing, temporary permits to |
| 38 | existing certificate holders and temporary public vehicle |
| 39 | driver's licenses provided that such temporary permits and |
| 40 | temporary public vehicle driver's licenses shall be issued for a |
| 41 | period of time not to exceed 7 days. Upon showing of good cause, |
| 42 | temporary permits or temporary public vehicle driver's licenses |
| 43 | may be reissued, but shall not be reissued more than four 4 |
| 44 | successive 7-day seven-day periods without commission approval. |
| 45 | Issuance of a temporary permit or a temporary public vehicle |
| 46 | driver's license pursuant to the provisions of this section |
| 47 | shall not in any way be construed as a commitment to issue a |
| 48 | permanent permit or annual public vehicle driver's license. No |
| 49 | action taken by the commission, or by the director or any |
| 50 | interim director if so authorized, shall be construed to estop |
| 51 | the commission from subsequently denying an application for a |
| 52 | permanent permit or annual public vehicle driver's license. |
| 53 | Section 8. Public vehicle driver's license.-- |
| 54 | (5) Each public vehicle driver's license: |
| 55 | (b) Shall be valid for 1 year and may be renewed annually |
| 56 | for 1 additional year when the commission finds no criminal or |
| 57 | traffic violations during the period of the expiring license. If |
| 58 | the investigation reveals such violations, the license shall not |
| 59 | be valid for more than 60 days, providing further, however, that |
| 60 | temporary public vehicle driver's licenses are exempt from this |
| 61 | paragraph. |
| 62 | Section 2. This act shall take effect upon becoming a law. |
