A bill to be entitled
2An act relating to sexual battery time limitations;
3amending s. 775.15, F.S.; revising time limitations for
4prosecution of certain sexual battery offenses involving
5minor victims; requiring corroborating evidence in certain
6circumstances; providing an effective date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Paragraph (c) is added to subsection (13) of
11section 775.15, Florida Statutes, to read:
12     775.15  Time limitations; general time limitations;
13exceptions.--

15     (c)  If the offense is a second degree felony violation of
16s. 794.011, the offender committed the offense on two or more
17diverse occasions, and the victim was under 18 years of age at
18the time the offense was committed, a prosecution of the offense
19may be commenced at any time. However, if the alleged offense
20occurred more than 3 years prior to the date that such offense
21is to be charged, then the offense shall require proof beyond
22the testimony of a single victim through other corroborating
23evidence. This paragraph applies to any such offense except an
24offense the prosecution of which would have been barred by
25subsection (2) on or before October 1, 2008.
26     Section 2.  This act shall take effect October 1, 2008.
