| 2 | An act relating to trust funds; creating the Florida |
| 3 | Gaming Trust Fund within the Department of Gaming Control; |
| 4 | providing the sources and purpose of the trust fund; |
| 5 | requiring funds to remain in the trust fund at the end of |
| 6 | each fiscal year; providing for future review and |
| 7 | termination or re-creation of the trust fund; providing a |
| 8 | contingent effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Florida Gaming Trust Fund.-- |
| 13 | (1) There is created the Florida Gaming Trust Fund within |
| 14 | the Department of Gaming Control. Moneys deposited in the fund |
| 15 | shall be those collected from sources designated by state law. |
| 16 | The purpose of the trust fund is to provide funding for the |
| 17 | regulation of skill-based machine gaming and slot machine |
| 18 | gaming. |
| 19 | (2) Notwithstanding s. 216.301, Florida Statutes, and |
| 20 | pursuant to s. 216.351, Florida Statutes, any balance in the |
| 21 | trust fund at the end of any fiscal year shall remain in the |
| 22 | trust fund at the end of the fiscal year and shall be available |
| 23 | for carrying out the purposes of the trust fund. |
| 24 | (3) In accordance with s. 19(f)(2), Art. III of the State |
| 25 | Constitution, the trust fund must, unless terminated sooner, be |
| 26 | terminated on July 1, 2012. Before its scheduled termination, |
| 27 | the trust fund must be reviewed as provided in s. 215.3206(1) |
| 28 | and (2), Florida Statutes. |
| 29 | Section 2. This act shall take effect July 1, 2008, if HB |
| 30 | 1385, or similar legislation creating the Florida Gaming |
| 31 | Commission and the Department of Gaming Control, is adopted in |
| 32 | the same legislative session or an extension thereof and becomes |
| 33 | law. |
