3     Amendment(with title amendment)
4     Remove lines 1865-1879 and insert:
5     (4)(a)(5)  When bonds are outstanding which have been
6issued to finance or refinance any turnpike project, the tolls
7and all other revenues derived from the turnpike system and
8pledged to such bonds shall be set aside as may be provided in
9the resolution authorizing the issuance of such bonds or the
10trust agreement securing the same. The tolls or other revenues
11or other moneys so pledged and thereafter received by the
12department are immediately subject to the lien of such pledge
13without any physical delivery thereof or further act. The lien
14of any such pledge is valid and binding as against all parties
15having claims of any kind in tort or contract or otherwise
16against the department irrespective of whether such parties have
17notice thereof. Neither the resolution nor any trust agreement
18by which a pledge is created need be filed or recorded except in
19the records of the department.
20     (b)  Prior to October 1, 2008, the department shall conduct
21a study of the turnpike system users that determines the number
22of vehicles that enter the Bird Road Plaza and then connect onto
23the Miami-Dade Expressway Authority system. No later than March
241, 2009, the department shall enter into a revenue-sharing
25agreement with the Miami-Dade Expressway Authority which
26provides for the transfer of 25 percent of the revenues
27equivalent to the amount of revenues generated by the vehicles
28that enter the Bird Road Plaza and then connect onto the Miami-
29Dade Expressway Authority system as determined by the study. The
30agreement shall be updated based on subsequent traffic studies
31conducted at such frequency as agreed to by the department and
32the Miami-Dade Expressway Authority, but in no event shall the
33agreement be updated more frequently that once every 2 years and
34no less frequently than once every 5 years.
