3     Amendment (with title amendment)
4     Between lines 48-49 insert:

6     Section 1.  Paragraphs (d) and (e) of subsection (6) of
7section 161.053, Florida Statutes, are redesignated as
8paragraphs (e) and (f), respectively, and a new paragraph (d) is
9added to that section, to read:
10     161.053  Coastal construction and excavation; regulation on
11county basis.--

13     (d)  If, pursuant to subsection (2), the department
14reestablishes a coastal construction control line after January
151, 2008, and if the application of paragraph (b) would preclude
16the construction of a structure on a parcel the majority of
17which was previously not subject to the jurisdiction of the
18coastal construction control line program, the department may
19issue a permit for a single-family dwelling on the parcel if the
20applicant successfully demonstrates that:
21     1.  The parcel for which the single-family dwelling is
22proposed was platted or subdivided by metes and bounds prior to
23July 1, 2008.
24     2.  The owner of the parcel for which the single-family
25dwelling is proposed does not own another parcel immediately
26adjacent to and landward of the parcel for which the dwelling is
27proposed.
28     3.  The proposed single-family dwelling is located landward
29of the frontal dune structure.
30     4.  The proposed single-family dwelling will be as far
31landward on its parcel as is practicable without being located
32seaward of or on the frontal dune.
