| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Section 445.061, Florida Statutes, is created |
| 13 | to read: |
| 14 | 445.061 Florida Business and Workforce Competitiveness |
| 15 | Trust Fund.-- |
| 16 | (1) The Florida Business and Workforce Competitiveness |
| 17 | Trust Fund is created within the Agency for Workforce Innovation |
| 18 | and shall be administered by the regional workforce boards, as |
| 19 | defined in s. 445.007, upon allocation by Workforce Florida, |
| 20 | Inc. Funds credited to the trust fund shall consist of |
| 21 | employment training investment assessments from employer |
| 22 | contributions under s. 443.131. |
| 23 | (2) The trust fund is established for use as a depository |
| 24 | for funds to be used for the purposes of the Florida Business |
| 25 | and Workforce Competitiveness Program established in s. 445.06. |
| 26 | (3) Notwithstanding s. 216.301 and pursuant to s. 216.351, |
| 27 | any balance in the trust fund at the end of any fiscal year |
| 28 | shall remain in the trust fund at the end of the year and shall |
| 29 | be available for carrying out the purpose of the trust fund. |
| 30 | (4) In accordance with s. 19(f)(2), Art. III of the State |
| 31 | Constitution, the Florida Business and Workforce Competitiveness |
| 32 | Trust Fund shall, unless terminated sooner, be terminated on |
| 33 | July 1, 2012. Before its scheduled termination, the trust fund |
| 34 | shall be reviewed as provided in s. 215.3206(1) and (2). |
| 35 | Section 2. This act shall take effect July 1, 2008, if |
| 36 | House Bill 1505, or similar legislation, is adopted in the same |
| 37 | legislative session or an extension thereof and becomes law. |
